2. General information on data processing

We process personal data only to the extent that this is necessary to provide our website, to handle enquiries, to publish listings, to perform our contractual relationships, or on the basis of consent. Personal data is, in particular, information that allows a person to be identified, directly or indirectly.

3. Accessing our website / server log files

When you access our website, technically required information may be processed by the web server. This may include, in particular, the IP address, date and time of access, the page or file accessed, browser type and version, operating system, referrer URL and technical status information.

This processing is carried out to provide the website securely and free of technical errors, and to detect and defend against faults and attacks. The legal basis is Art. 6(1)(f) of the General Data Protection Regulation (GDPR). Our legitimate interest lies in the secure and functional operation of our website.

4. “List your apartment” form

If you enquire about a listing via our website, we process the data you enter into the form. This may include, in particular, your name or company, email address, telephone number, location, the type of offer, and further details on the apartment, room, workspace or other offer being advertised.

The information is used initially to process your enquiry and for subsequent contact. Submitting the form does not automatically result in a chargeable contract. This processing is carried out for the performance of pre-contractual measures and, once a contract has been concluded, for the performance of the contract pursuant to Art. 6(1)(b) GDPR.

5. Publication of a listing

Once commissioned accordingly, the information intended for the listing is published on Modelle Apartment. This may include, in particular, the name or trading name of the provider, telephone number, email address, location, description of the offer, prices, images and other information expressly designated for the listing.

Please note that, as a rule, published data can be viewed by any visitor to our website.

Publicly accessible information may also be indexed by search engines and displayed in their search results. After publication, we have only limited influence over its processing by independent search engine operators.

6. Contact by phone or email

If you contact us by phone or email, we process the data you provide in order to handle your enquiry. Where the contact serves to initiate or perform a contract, this processing is carried out on the basis of Art. 6(1)(b) GDPR. In other cases, this processing may be carried out on the basis of our legitimate interest in handling the enquiry pursuant to Art. 6(1)(f) GDPR.

7. Invoicing and payment data

In connection with chargeable listings, we process the data required for invoicing. This includes, in particular, your name or company, billing address, invoice amount, payment information and details required under tax law. This processing is carried out for the performance of the contract and to comply with statutory retention obligations under commercial and tax law.

8. Cookies and similar technologies

Our website uses cookies and, where applicable, comparable technologies. Technically necessary cookies may be used to the extent required to provide the website functions you have expressly requested.

Other cookies or comparable technologies, in particular for statistics, analytics or marketing purposes, are only used if you have previously given your consent via our consent management system. You can manage your choices via the cookie settings and revoke any consent given, with effect for the future.

9. Cookie consent management

On your first visit to our website, you can use the cookie banner displayed to decide whether, in addition to technically necessary technologies, further services may be used. In particular, you can choose between “Accept all”, “Accept necessary only” and “Manage settings”. Consent once given can be changed or revoked at any time, with effect for the future, via the cookie settings.

10. External analytics, maps and marketing services

To be completed technically prior to going live. If, for example, Google Analytics, Google Maps, Meta Pixel or comparable external services are used, the services actually used must be specifically described, including the provider, purpose, legal basis, retention period and, where applicable, any transfer to third countries. Services requiring consent may only be loaded after the corresponding selection has been made in the cookie banner.

11. Retention period

As a rule, we store personal data only for as long as is necessary for the respective purpose. Where statutory retention obligations under commercial or tax law apply, certain contract and billing data may be stored for a correspondingly longer period. Once the purpose of processing no longer applies and the statutory retention periods have expired, the data is deleted, unless another legal basis exists for further processing.

12. Disclosure of personal data

Personal data is disclosed only where this is necessary for the performance of the contract, where a statutory obligation exists, where we have a legitimate interest, or where you have given your consent. Technical service providers who process personal data on our behalf are engaged, where necessary, on the basis of corresponding data processing agreements.

13. Your rights

Subject to the statutory requirements, data subjects have, in particular, the right to obtain information about the personal data processed, to rectification of inaccurate data, to erasure, to restriction of processing, to data portability, and to object to certain processing. Consent given can be revoked at any time, with effect for the future. To exercise your rights, you may contact Perfect in Vision GmbH using the contact details given above.

14. Right to lodge a complaint with a supervisory authority

Data subjects have the right to lodge a complaint with a competent data protection supervisory authority regarding the processing of their personal data.

15. Amendments to this privacy policy

We reserve the right to amend this privacy policy if our website, the services used, or statutory requirements change.
